General Terms & Conditions (GTC)

These General Terms and Conditions apply to all business transactions of Beyond Success GmbH. They govern the contractual relationship between the client and Beyond Success GmbH.

 

Formation of Contract

Unless otherwise agreed, offers from Beyond Success are valid for 30 days. A contract is only concluded upon written placement of an order by the client. Orders may be submitted to Beyond Success by email, postal mail, or personal delivery. Beyond Success may decline to accept orders without providing reasons, and may interrupt, reduce, or terminate the execution of an order prematurely if the client makes fulfilment difficult or impossible, or if the client is in default of payment.

 

Liability

Beyond Success carries out all assignments with the greatest possible care and the requisite quality. However, Beyond Success accepts no liability for the outcome of its activities. The liability of Beyond Success for damages is expressly excluded to the extent permitted by law. In particular, Beyond Success accepts no liability for damages attributable to circumstances for which Beyond Success is not responsible.

 

Confidentiality, Data Protection, and Data Security

Beyond Success and the client mutually commit to maintaining the confidentiality of all non-public information and data that becomes accessible to them during the preparation and execution of the contract. This obligation continues after the termination of the contract for as long as there is a legitimate interest in doing so.

 

Beyond Success and the client shall each ensure data protection and data security within their respective areas of influence and responsibility. Beyond Success collects and processes personal data as described in its privacy policy, in accordance with any supplementary agreements with the client, and in compliance with the Swiss Federal Act on Data Protection (FADP) and other applicable laws.

 

Beyond Success undertakes to treat all information received from the client in strict confidence and to use it exclusively for the execution of the assignment. Contrary agreements remain reserved. Beyond Success implements appropriate and suitable technical precautions and security measures to protect against unauthorised access to data or unauthorised modification, disclosure, or deletion thereof.

 

We typically collect data from the following categories: CV/résumé and contact details, including notes from conversations or third-party remarks. The collection of personal and confidential data at Beyond Success is subject to the following principles:

  • By submitting a CV or other data to Beyond Success, the individual concerned consents to their data being included in our database.

  • Beyond Success strives to establish a trusting and long-term relationship with clients and customers in order to provide ongoing advisory support as needed. However, consent to data storage may be withdrawn at any time and deletion of data may be requested. Beyond Success is the sole owner of the personal data and uses it exclusively for its advisory purposes within the legally permitted or required framework. Data from client projects is deleted or destroyed after 18 months.

Since absolute security in data transmission cannot be guaranteed, no liability is accepted for any resulting damages. In particular, no liability is accepted for actions or negligence of third parties by which data is altered, deleted, or otherwise compromised. We also refer to the separate privacy policy published on our website.

 

Cancellation Conditions

  • Consulting / Coaching / Advisory: If the client terminates a consulting, coaching, or advisory project prematurely, all costs incurred up to that point, plus 50% of the costs not yet rendered under the contract, shall be due. In connection with a programme, the amounts stated in the offer become due upon commencement, even if the programme is terminated early. For health reasons or extended absences, the programme may be suspended, but for a maximum of 6 months.

  • Potential Analysis and Executive Assessment: Cancellations made later than 14 days before the agreed date of the Potential Analysis or Executive Assessment will be charged at 50% of the fee, and cancellations made later than 7 days before the start date will be charged in full, in accordance with the written offer.
     

  • Training and Academy: Cancellations made later than 45 days before the training date will be charged at 50% of the quoted seminar price, and cancellations made later than 30 days before will be charged in full. In the absence of a written cancellation or deregistration of individual participants, the full seminar costs are also due.

 

Expenses and Third-Party Costs

Travel expenses are charged at actual cost (first-class rail or CHF 0.85 per km by car), meals and accommodation at actual cost. Costs for third-party services such as hotels, translations, and production of materials are borne by the client and invoiced accordingly.

 

All of the above applies exclusively unless otherwise agreed with the client in advance. As a general rule, Beyond Success incorporates any likely expenses into its offers, so that no additional costs arise for the client.

 

Severability Clause

Should any of these provisions or parts thereof be or become invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a provision that most closely reflects its intended economic purpose.

 

Any agreements deviating from these GTC require written form.

 

Applicable Law and Place of Jurisdiction

These GTC and any legal disputes arising from or in connection with the contractual relationship between Beyond Success and the client are subject exclusively to Swiss law. The exclusive place of jurisdiction is Zurich.
